<국문초록>

클라우스 슈밥이 처음 제창한 제4차 산업혁명이라는 개념은 의미가 불명확하고, 아직 종래의 산업혁명과 동일한 차원에서 논의할 수 있는지에 대해 반론이 적지 않다. 하지만 인공지능, 사물인터넷, 빅테이터, 모바일 등 첨단 정보통신기술이 경제, 사회 전반에 융합되어 혁신적인 변화가 나타나는 차세대 산업혁명으로서의 제4차 산업혁명이 사회, 경제적으로 심대한 영향을 미치고 있고 여기에 금융도 포함이 됨에는 이론의 여지가 없을 것이다. 본고는 이러한 측면에서 제4차 산업혁명의 기술적 변인과 결과, 그에 따른 금융의 변화 및 금융법의 과제에 대해 금융업, 금융시장, 금융규제라는 세 가지 관점에서 정리하였다. 첫째, 금융업에 있어 제4차 산업혁명은 비금융업과 금융업 사이의 융화와 금융업 내부의 경계 무너짐 현상을 가속화할 것이다. 비금융업의 금융업 진출과 관련해서 금융법적으로는 금산분리 원칙이 문제되는데 이해상충, 위험전파, 경제력 집중의 세가지 측면에서 전반적인 검토가 필요하다는 점을 살폈다. 한편, 플랫폼 비즈니스의 금융업 진출은 제조에 대한 판매 우위 상황에서 금융업 내부경계를 붕괴시킬 것이다. 이에 대해서는 판매와 광고의 구분, 업무위탁 등 금융법적 과제가 제기되며 장기적으로는 금융법의 판매기능의 종합적 규제로의 전환도 고려할 필요가 있다. 둘째, 금융시장에 있어 제4차 산업혁명은 은행 중심의 지급결제시장에 큰 변화를 가져올 것이다. 편의성을 극대화한 핀테크기업의 지급결제시장 진출은 예금을 바탕으로 한 은행 중심 시스템에 위기요소이다. 역사적인 요인으로 지급결제를 은행의 업무로 규정하고 있지는 않으나 경제시스템의 중핵을 이루는 요소라는 측면에서 지급결제업무를 수행하는 전자금융업자에 대한 규제를 어떻게 설계 할지 검토가 필요하다. 또한 제4차 산업혁명은 새로운 거래수단의 등장이라는 측면에서 자본시장에도 영향을 미칠 것이다. 알고리즘 거래와 같은 새로운 거래수단은 종래의 정보의 비대칭이 아닌 수단의 비대칭이라는 문제를 제기한다. 나아가 제4차 산업혁명의 변화를 수용하지 못하는 금융소외계층에 대한 포용적 금융의 필요성이 제기되고 그와 함께 은행의 공공적 역할에 대한 고민이 필요하다. 셋째, 금융규제에 있어 제4차 산업혁명은 위기이자 기회가 될 것이다. 우선, 제4차 산업혁명이 내포하고 있는 기술성, 속도성, 복잡성은 민간부문에 비해 정부부문에 어려움을 가중시킨다. 기존 금융규제방식이 한계에 도달하고, 그에 따라 금융규제의 역할을 재검토할 필요가 있다. 규제실패의 가능성도 고민이 필요한 영역이다. 한편, 위험기반규제나 행위자규제는 제4차 산업혁명으로 인해 보완이 필요하다. 종래의 위험측정방식은 알고리즘 거래와 같은 새로운 거래수단으로 인해 무력화될 수 있고, 인공지능이나 알고리즘의 발달은 행위자규제로 대응이 어려울 수 있다. 하지만 새로운 기술들은 금융당국 입장에서 새로운 규제수단을 제공한다. 레그테크, 섭테크에 대한 논의를 주목할만 하다. 금융법적으로는 원칙중심규제, 자율규제기구에 대한 위임가능성 등을 고민할 필요가 있다.

<Abstract>

The definition of the fourth industrial revolution (hereafter ‘the revolution’) is not definitely confirmed and there is still a controversy whether the revolution could be assessed as an industrial revolution like the first, the second and the third industrial revolution. However, it is clear that various technical developments which consist of the revolution have an effect on the finance industry as well as the finance law significantly. In this paper, the tasks of the finance law followed by the revolution are discussed for the three aspects of the finance industry, the finance market and the financial regulation. Firstly, in the finance industry, the revolution will accelerate a reconciliation between banking and commerce and collapsing of the barriers among each finance industries. Regarding the entering of non-finance into finance industry will raise an issue of separation between banking and commerce. This issue should be reviewed for the three aspects of interest conflict, risk spread and concentration of economic power. The appearance of platform businesses will collapse the barriers among each finance industries. For the platform business, the classification between advertisements and sales, work commitment would be issued for the finance law. Secondly, the revolution will bring significant changes to the finance market. The entering of fintech companies into payment and settlement system would have an effect on the banking system significantly. Considering of the importance of payment and settlement in the finance system, this changes should be reviewed for the planning of the financial regulation. The revolution which includes various trading technics and commodities will influence a capital market as well. New trading devises such as an algorithmic trading would raise a problem of asymmetry of device not an information. Also, the revolution will raise a issue of financial inclusion for the people who are not accommodated to the rapid changes and the public role for the bank. Thirdly, the revolution will be not only the crisis but also new opportunities for the the regulatory authorities. The technical aspect and character of speed, complexity of the revolution will be burden to the public sector comparing to the civil one. The role and the way of the financial regulation should be reviewed accordingly. On the one hand, the risk based approach and a direct regulation to the performer would come to a head. Considering new technics such as algorithm and AI, the possibilities of the regulation failure should be considered. However, new technical development would open doors for the regulatory authority. Regtech and Suptech would be new items to the hand of the financial regulation.
