<국문초록>

현행법에서 지방소득세를 계산할 때에는 과세표준 산정까지의 단계와 그 이후가 구별된다. 지방소득세의 과세표준은 국세인 소득세나 법인세의 그것과 같지만, 그 이후에 적용되는 세액공제․감면(減免)에 관하여는 지방세에 고유한 규정을 두는 일이 가능하다. 이와 같이 국세의 과세표준을 빌려다 쓰고 있는 것과 관련하여, 지방세법은 국세 과세관청이 지방세 과세관청에 일정한 ‘통보’를 할 의무와, 이러한 통보를 받은 지방세 과세관청이 이에 따라 세액을 ‘재계산’할 의무를 지우는 등 몇 가지 독특한 규정을 두고 있다. 하지만 이러한 지방소득세의 신고․부과․징수에 이르는 절차적 단계에서 국세 과세관청과 지방세 과세관청 간의 상대적 관계가 항상 명확하게 규정되어 있지는 않기 때문에, 이러한 의미에서 입법의 흠결(欠缺)과 공백이 존재한다고 말할 수 있다.
이 글은 이러한 법 상황을 고려한 결과로서, 지방세법이 과세표준의 계산까지 이르는 과정에서 국세 과세관청에게 일정한 ‘주도적 지위’를 체계적으로 부여하고 있다는 일반론을 잠재적으로 세운 후 그 타당성을 몇 가지 측면에서 확인하여 본다. 대략 말하자면 ‘통보 조항’과 ‘재계산 조항’을 비롯하여 현행법이 두고 있는 몇몇 규정들이 실정법의 차원에서 이를 뒷받침하고, 나아가 실제로 지금까지 이어져 내려온 실무가 그러하다는 연혁적(沿革的) 측면 외에, 같은 사항에 관한 법적 판단을 두 과세관청이 중복하여 내릴 이유가 없다는 당위(當爲), 그리고 또 소득세․법인세 과세표준에 관한 판단에는 국세 과세관청이 고유의 전문성을 가진다는 현실이 함께 이러한 결론의 타당성을 강화한다. 이 글은 이 절차법적 ‘주도권’의 전제에 따른 일관된 구체적 해석론으로서, 과세표준에 관한 법적 판단을 내릴 권한이 국세 과세관청에 전속(專屬)하고 그러한 판단이 지방세 과세관청을 기속(羈束)한다는 점, 과세표준에 관한 쟁점이 문제되는 범위에서 쟁송 절차의 피고 적격이 국세 과세관청에게만 인정된다는 점 등을 주장한다. 일정한 내적(內的) 일관성을 가지는 이러한 해석론은 현실에서도 충분히 타당한 결과를 가져오기 때문에, 그러한 면에서도 이 글의 논의가 그 가치를 인정받을 수 있으리라 생각한다. 그리고 이 글은 그에 더하여 지방세 과세관청이, 국세 과세관청이 필요한 조치를 취한 후 비로소 그에 따른 조치를 취하게 됨과 관련하여, 제척기간이나 소멸시효에 관하여 특별한 정함을 둘 필요가 있다는 점을 아울러 논의한다.
한편 지방세를 관장하는 행정부처인 행정안전부는 지방소득세 세액공제 · 감면에 관한 독자적인 규정을 두고자 하는 노력을 현재 기울이고 있다. 앞으로 이 방향으로 법이 계속하여 바뀌어 간다면 그러한 세액공제․감면의 영역에서는 (국세 과세관청의 주도권 없이) 지방세 과세관청 스스로가 판단을 내리고 필요한 조치를 취하여야 한다. 무엇보다 그 전에 이러한 일을 무리 없이 해낼 수 있는 역량을 충분히 쌓을 수 있도록 자원을 투입하여야 할 것이다.

<Abstract>

The Korean Local Tax Act (“LTA”) provides that its Local Income Tax (“LIT”) is computed based on the same taxable income as the (national) Personal or Corporate Income Tax, but may apply its own rules when it comes to tax exemption or reduction, or credits. Taking into account this “sharing” of the “taxable income,” the LTA requires the national tax authorities to make a “notification” to its local counterpart after taking certain measures such as issuing of a tax assessment, for example. Then the local tax authorities are in turn obliged to “re-calculate” accordingly the relevant LIT liability and take ensuing actions. Against this statutory background, this article attempts to establish the general thesis that the national tax authorities systematically play a “leading role” over its local counterparts. This article submits that this understanding is supported by a number of factors:the fact that it coincides with the practice that has been long and stably in place, the general norm that the two tax authorities need or should not be required to make decisions over the same or overlapping issues, and the reality that the national tax authorities have far better expertise in computing taxable income, as well as the existence of such statutory provisions as so-called “notification” or “re-calculation” clauses in the LTA. The concrete implications of this “leading role” as far as issues relating to taxable income go include, this article argues, the exclusive competence of the national tax authorities to initiate tax audits and issue resulting tax assessments, their binding effects on the local tax authorities, and the lack of standing of the local tax authorities at court procedures. Considering that the local tax authorities often take the relevant measures only after its national counterpart has initiated first necessary steps to make either tax assessments or refunds, this article adds thereto discussions on whether to insert certain special rules that hinder statute of limitations from lapsing. Meanwhile, the Korean Ministry of Interior and Safety has made efforts to enact some autonomous rules that govern exemptions, reductions, and tax credits that apply to LIT, which are detached from the corresponding rules on the national income tax. If the LTA indeed incurs changes along with these paths, the local tax authorities will then have to make its own decisions in interpreting and applying the relevant statutory provisions to the extent that exemptions and reduction, and tax credits are concerned. In this regard, the foregoing Ministry should make adequate investments beforehand in both human and material resources so they may be up to the task of dealing with these legal issues without suffering too much difficulty.
